Where a party is not legally represented, that party is advised to obtain legal advice before, during and after mediation.

Any settlement reached in mediation will not be legally binding until it has been recorded in writing and signed by the parties (or by representatives of the parties) on behalf of the parties.

Each party will pay its own costs of the mediation unless they come to a different agreement. This is however subject to any Court order that is made with regards to costs if a settlement is not reached.
